Terms and Conditions

 

Retainers, Deposits, Payments & Taxes

  1. A quote is valid for 14 days only.
  2. The payment for the cake, delivery charges and/or equipment deposit is due 14 days prior to the date it is required. Payment means the terms and conditions are accepted and booking is confirmed.
  3. If the cake is booked 14 days or less before the required date, payment in full will be required before the order will be processed.
  4. If the Client fails to make payment(s) as agreed, Urmy’s Cakes will cease work, the order will be cancelled, and no refund will be given.
  5. Preferred methods of payment are bank transfer and credit card.
 

Postponement/Cancellation

  1. The Client must notify Urmy’s Cakes at least 10 days prior to the required date if there is a change in the date or a complete cancellation. Changes will only be made if there is availability on the new date. No refunds will be given for change of mind or change of date. 
  2. No refund is available for cancellation of cakes within 14 days of due date. Please advise of any cancellation requests in writing (email). We may be able to transfer the booking to another date if the new date is available and if the request is made a month in advance of the new date.
  3. No refund will be available from cancellation due to sickness, natural disasters or other incidents, including Covid-related lockdowns or isolation, if less than 14 days from event date. 
  4. Any refund given for disputes regarding a cake design or production of a design are completely at the discretion of Urmy’s Cakes and are not automatic. 
  5. Full refunds will not be given for any cake which has been consumed regardless of dispute, as consumption of the cake is viewed as your acceptance that the cake is adequate for the purpose for which it has been supplied. 
 

Design of the Cake

  1. Urmy’s Cakes will follow the Client’s requests closely to create the cake design desired. 
  2. Urmy’s Cakes cannot duplicate an exact copy of another cake artist’s work but will ensure that the look is similar.

Changes to Order

  1. Any changes must be submitted 14 days in advance.
  2. Additions or changes may incur additional fees.
  3. Small changes to design may be made by Urmy’s Cakes if they are not possible with sugar paste, or if the design isn’t working.
  4. Changes of flavour and design may be made by Urmy’s Cakes if there is an issue with supply of ingredients. 
 

Serving Amount & Sizes

  1. The standard serving size is 1 inches wide x 2 inches long x 4 inches high for a DESSERT SIZED SERVING
  2. The standard serving size is 1 inches wide x 1 inches long x 4 inches high for a COFFEE SIZED SERVING
  3. Serving size estimations are not guaranteed to be exact.
  4. Urmy’s Cakes is not responsible for a shortage of cake if the pieces are cut too large.
  5. Internal structure required on a cake may affect serving sizes.
 

Allergy & Dietary Warnings and Inedible Items

  1. Urmy’s Cakes’s baked goods may have come in contact with various allergens. All Urmy’s Cakes products are egg free. Urmy’s Cakes is able to make allergy friendly cakes (vegan, nut free and gluten free cakes) and all care will be taken, however there may be traces from using shared equipment and traces from manufacturing from suppliers.
  2. Natural dyes, artificial dyes, artificial flavourings, sugar, artificial sweeteners, artificial colour and other allergens not listed.
  3. The Client is responsible for pointing out potential allergy hazards to their guests. No responsibility is taken for allergic reactions.
  4. Please be aware that toppers and flowers often contain toothpicks or cake wire to give it support or secure it to a cake. Ensure that the toothpicks are removed before giving any toppers to someone to eat. You will be advised in person where toothpicks are on your cake on collection. No responsibility will be taken for any toppers eaten where the customer has not removed the internal structure.
  5. Multiple tiered cakes will contain internal structure for support. This may include cake boards, skewers, bubble straws, a centre support pole or rice crispy treats. If this affects the serving sizes, you will be advised when quoting your cake. Please ensure any structure should be removed before serving. All structures will be food safe.
  6. Some shimmers and gold sprinkles are non-toxic but are not considered edible. If you request a shimmer that is not edible, you will be advised to take it off the cake before serving.

Ornaments & Special Equipment

  1. A $100 deposit is required for all rental equipment. Please advise if equipment is needed on booking your cake as supply is limited.
  2. The equipment must be returned within 3 days of the event.
  3. The returned equipment is evaluated, and a refund of the deposit is based on the condition of the items.
  4. All personally supplied items must be submitted to Urmy’s Cakes at least 10 days prior to the required date for the cake.
 

Collection, Transport and Storage

  1. If the Client picks up the cake, Urmy’s Cakes no longer assumes any responsibility for damage caused to it, so please ensure safe transport of your cake.
  2. The Client is responsible for ensuring the cake is transported in a suitable environment. The cake will be affected by heat so please ensure it is not left in a hot car. Please advise Urmy’s Cakes if your cake has to travel a very long distance. Urmy’s Cakes can provide valuable advice on transport and storage, so please ask if you are unsure.
  3. The cake can be quite heavy, so ensure it is handled with care. For large cakes you may need two people to lift it. Ensure that the cake is held only by the cake board or box provided. Please check that any cake stands are able to handle the weight of your cake. Urmy’s Cakes is not responsible for injuries from lifting heavy cakes, unbalanced cake boards or cake stands.
  4. Sugar paste / fondant icing is not designed to be refrigerated and as such cakes with this icing should be stored in a cool dry place, preferably in the box they were supplied in. Refrigeration may cause colours to run. Please ask Urmy’s Cakes for storage advice if unsure.
  5. Cakes are to be collected from our premises at a prearranged time and date only (refer to Appendix 1 for available collection times). Urmy’s Cakes works to a tight schedule, often have multiple cake pickups and deliveries to be made in the one day. Late cake pickup can result in no one being available for your cake to be collected. Any changes to pickup time will need to be confirmed at least 3 hours prior to the original appointed time.
  6. Pickups more than 30 minutes after the appointed time will incur a $20 late pickup fee. 
  7. Damage may occur to cakes in hot or in high humidity environments. Please advise Urmy’s Cakes if your cake needs to be displayed outside for valuable storage and display advice. No responsibility will be taken for damage occurred to cakes exposed to weather, heat or humidity.
  8. Once you have collected your cake and left the premises, no changes will be made to the cake. Please check the cake before you leave.

Delivery and Set Up

  1. There is a delivery fee of $1 per kilometre return, with a minimum charge of $10.
  2. Urmy’s Cakes is not responsible for tardiness if the venue is changed within 48 hours of the delivery.
  3. The Client may pick up the cake. The Client assumes liability once it passes into the Client’s possession.
  4. The Client is responsible for providing a suitable environment for the cake (away from heaters, vibrations, people, suitable surface, suitable outdoor setting).
  5. Once the cake is delivered and photographed, Urmy’s Cakes is not responsible for cake including collapse, melting, pokes, etc.
  6. All cakes delivered to venues are photographed from different angles to show cake quality on delivery. We do not accept any responsibility for loss or damage to the cake or items with the cake, such as knives, decorations and stands, once the cake has been delivered to a venue or collected from our premises, or for loss, damage or non-delivery under unavoidable or exceptional circumstances.
 

Liability and Fulfillment of Contract

  1. Urmy’s Cakes is not responsible for bodily injury, property or consequential damage, which may result from services.
  2. Urmy’s Cakes is not responsible for any damage to the cake or shortage of cake caused by anyone NOT employed by Urmy’s Cakes.
  3. Urmy’s Cakes will not deliver a cake if payments have not been paid in full.
  4. Urmy’s Cakes is not responsible for any delay or inability to deliver based on accidents, natural disasters, transportation issues, inclement weather, illness, death, labour troubles, delay in supplies, disputes or strikes, or any other circumstance beyond Urmy’s Cakes’s control.
 

Photographs

  1. Urmy’s Cakes reserves the right to use all photographs of the cake for advertising purposes, marketing and promotion for our business, including social media, without compensation to the Client. Should the Client wish for this not to occur, please advise us in writing beforehand to ensure no misunderstanding.

 Clients can arrange to collect their cakes / products from Urmy’s Cakes premises by pre-arranging a time from the available times as given in the table below:
